There are 3 branches of Government. The Executive Branch, Judicial Branch and Legislative Branch. The Legislative branch is the branch that passes new laws to which EVERY citizen of our Country must abide.
When a person commits a crime and they ask for a trial, they can ask for a jury of their peers to judge them based on current laws. Evidence is introduced by prosecutors and contradictory evidence and/or tactics are used by the defense. Once the case has is done, the attorneys, prosecution and defense present their closing arguments to the jury to deliberate and for a final judgement. THAT JUDGEMENT is based SOLELY on the evidence presented, not the gender of the defendant, not the religion of the defendant, and certainly not the political affiliation of the defendant. A fair thoughtful verdict is presented to the judge based ONLY ON EVIDENCE.
On February 8th, a body of U.S. Senators SHOULD and hopefully will, set aside their political allegiances to hear the evidence, weigh the evidence, and finally to present a VERDICT based SOLELY on that evidence. Their verdict should be void of political affiliations, biases or allegiances. Anything less than that is a dereliction of their civic duty and in direct contradiction of the sworn oath the took to defend the CONSTITUTION of the United States. In addition to the Oath of Office they took when sworn into the Senate, for the impeachment trial they take a second oath for the sole purpose of the trial, it reads:
“Do you solemnly swear that in all things appertaining to the trial of the impeachment of the president of the United States, now pending, you will do impartial justice according to the Constitution and laws, so help you god?”
U.S. Constitution
In other words, if these Senators see UNLAWFUL behaviors (not what they perceive as legal), but if they have undisputed evidence that a LAW was broken…they MUST VOTE to convict. Furthermore, in an impeachment trial, it doesn’t even have to be an unlawful act because a President can be convicted on the behaviors alone (for example inciting an insurrection), regardless if the article(s) are unlawful or not, behaviors that are so egregious can also warrant a conviction in the Senate.
If this were in a criminal court with a credible jurors, this would be a slam dunk case. Seriously, it’s almost as if the criminal (Trump) wanted to get caught for his criminal and bad behaviors. So, for the jury to find any verdict other than GUILTY or CONVICTION would be a terrible miscarriage of justice for the people of our Nation, but also for our Democracy too. It would send the message that indeed ANY PRESIDENT is above the law provided they have a corrupt Congress to go along with them and forsaking the Oath of Office to uphold and defend the Constitution of the United States.
Donald J. Trump must be convicted, and then immediately voted on to never hold office again.
